Small claims court: what it is and what varies

Small claims courts or tribunals provide simplified civil processes in many jurisdictions, but limits, eligible claims, forms, fees and deadlines are local.

Jurisdiction comes first

Before focusing on forms, determine which court or tribunal has authority over the dispute and parties.

Monetary limits change

For example, Ontario's current Small Claims Court monetary limit is $50,000; that figure should not be used for another province, state or country.

Procedure still matters

Simplified does not mean informal in every respect—service, evidence, filing and deadlines can still be important.

Use the current court source

Court websites and official procedural guides should be checked immediately before filing.
